These Terms constitute a legally binding agreement between you and the operators of the Application. Your access to or use of the Application constitutes your unambiguous acceptance of these Terms, including any amendments thereto posted in accordance with Section 11.
The Application is available to users of all ages, including minors, as it is designed as a publicly accessible educational reference resource. Users under the age of majority in their jurisdiction are encouraged to review these Terms with a parent or legal guardian. By using the Application, you represent that you understand and accept these Terms, or that a parent or guardian does so on your behalf.
If you are accessing the Application on behalf of an organisation, institution, or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, references to "you" shall refer to both you individually and the entity you represent.
The Application is an interactive, browser-based educational tool that presents scientific data pertaining to all 118 elements of the IUPAC standard Periodic Table of Elements. Features of the Application include, but are not limited to:
The Application is provided as a free, publicly accessible educational resource. No account registration, subscription, or payment is required for access.
The Application, including without limitation its source code, user interface design, visual elements, animations, layout, typography, colour schemes, and the selection and arrangement of scientific data, constitutes original creative and technical work protected by applicable copyright, database rights, and other intellectual property laws. All such rights are and remain the exclusive property of the Application's operators and/or their licensors.
Atomic and physical constants, element names, symbols, and atomic numbers are standardised designations established by the International Union of Pure and Applied Chemistry (IUPAC) and are not subject to proprietary ownership. Numerical data derived from established scientific literature and databases is similarly in the public domain. However, the selection, arrangement, annotation, and presentation of such data within the Application constitutes original authorship and is protected accordingly.
Any names, logos, or marks associated with the Application are trademarks or service marks of the Application's operators. Nothing in these Terms grants you any right or licence to use such marks without prior written consent.
If you submit suggestions, corrections, ideas, or feedback regarding the Application ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, adapt, publish, and incorporate such Feedback into the Application without restriction or compensation to you.
Subject to your full compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Application for your personal, non-commercial, and educational purposes.
The Application may be freely used in educational settings including, without limitation, classrooms, laboratories, academic presentations, and personal study. Screenshots and static reproductions of the Application's content may be used in educational materials provided that appropriate attribution is given to the Application as the source.
When reproducing content from the Application in academic, journalistic, or educational works, you agree to provide reasonable attribution in the form: "Source: Periodic Table of Elements (periodic-lab.com)" or substantially equivalent language.
You expressly agree not to engage in any of the following activities in connection with your use of the Application:
The scientific data presented in the Application is compiled from reputable sources including IUPAC publications, the National Institute of Standards and Technology (NIST) database, peer-reviewed literature, and established reference works. We make reasonable efforts to ensure the accuracy and currency of this data.
Atomic weights, standard reference data, and element classifications are periodically revised by IUPAC and other scientific bodies. The Application is updated as reasonably practicable, but there may be periods during which the data has not yet been revised to reflect the most current IUPAC recommendations.
The Application is intended for general educational and reference purposes only. The scientific data provided must not be relied upon for:
For critical professional or scientific applications, always consult primary sources and peer-reviewed literature.
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APPLICATION'S OPERATORS, DEVELOPERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:
ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION OR ANY CONTENT THEREIN, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow limitation of liability for consequential or incidental damages, our total liability to you in connection with the Application shall not exceed one hundred United States Dollars (USD $100.00).
You agree to defend, indemnify, and hold harmless the Application's operators, developers, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We reserve the right, at our own expense, to assume exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims.
The Application may reference, cite, or display data attributed to third-party scientific sources and databases. Such references are provided for informational and attribution purposes only. We do not endorse, warrant, or assume responsibility for the accuracy or completeness of any third-party source material.
The Application may contain links to external websites or resources. Such links are provided solely as a convenience. We have no control over the content, privacy policies, or practices of linked websites, and we expressly disclaim any responsibility or liability for any content, advertising, products, or other materials available through such websites. Your interaction with any linked website is governed by the terms and privacy policies of that website.
We reserve the right to modify, update, enhance, suspend, or discontinue any aspect of the Application at any time and without prior notice. This includes, but is not limited to, scientific data, features, user interface elements, and the availability of specific element information. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Application.
We reserve the right to revise these Terms at any time. We will indicate the date of the most recent revision at the top of this document. Continued use of the Application after any such change constitutes your acceptance of the new Terms. You are responsible for periodically reviewing these Terms for updates. If you disagree with any revised Terms, your sole recourse is to discontinue use of the Application.
We reserve the right, in our sole and absolute discretion and without prior notice or liability, to restrict, suspend, or terminate your access to the Application for any reason, including but not limited to:
Termination of your access does not relieve you of any obligations that accrued prior to termination, including any indemnification obligations. Sections 3, 7, 8, 9, and 13 of these Terms shall survive any termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Application's principal operators are established, without regard to its conflict of law provisions.
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at the address provided in Section 15. We will make reasonable efforts to resolve disputes within thirty (30) days of receiving written notice of the dispute.
For Users in jurisdictions where arbitration clauses are enforceable: any dispute, controversy, or claim arising out of or relating to these Terms or the Application that cannot be resolved informally shall be finally settled by binding arbitration administered in accordance with the arbitration rules of a mutually agreed arbitral institution. The arbitration shall be conducted in the English language. The award rendered by the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, you and we each waive the right to bring or participate in class action, collective action, or representative action proceedings in connection with any dispute arising out of these Terms or the Application.
Nothing in this Section limits either party's right to seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm, or to enforce intellectual property rights.
These Terms, together with our Privacy Policy (incorporated herein by reference), constitute the entire agreement between you and us with respect to your use of the Application, and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, relating to the same subject matter.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.
No waiver by us of any term or condition of these Terms shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to assert any right under these Terms shall not constitute a waiver of such right.
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performance of our obligations under these Terms arising from causes beyond our reasonable control, including acts of God, pandemics, natural disasters, governmental actions, internet or telecommunications infrastructure failures, or cyberattacks.
These Terms are drafted in the English language. To the extent any translated version of these Terms conflicts with the English version, the English version shall prevail.
